Are all personal injury lawyers the same?
I have litigated hundreds of personal injury lawsuits and claims. These matters ranged from claims of a few thousand dollars to multi-millions of dollars. As a consequence I know how to litigate a personal injury matter. Many lawyers claim that they are personal injury lawyers. One can only look to the yellow pages for those "claims." However, it has been my experience that most do not prepare the case correctly. I have seen countless cases, in which I was involved, that the Plaintiff's attorney did not know what he or she was doing. They were looking to make a "quick buck." They might have been very good tax or real estate lawyer. However, litigating a personal injury case in order to maximize the award requires specific training and experience.
I view a case from a unique perspective. I look at the matter from both a Plaintiff's and Defendant's perspective. I have represented both Plaintiffs and Defendants. When I represent a Plaintiff, I know how to maximize the recovery and avoid the defense "tricks of the trade." This view point actually benefits my clients who are injured Plaintiffs. I prepare the case anticipating these "tricks" and litigate the matter to avoid these hazards.
Most individuals believe that litigation is just about filing suit, exchanging documents, and going to trial. At which time the jury will find a great verdict for them. Almost everyone remembers the huge verdict against McDonalds Restaurant's "hot coffee." That result was an exception and not the usual result.
What makes juries award large verdicts? What makes insurance companies settle cases for a large figures? A lawyer must "paint a picture" to either the opposing lawyer or insurance company (before trial) or to a jury at trial. I, as the attorney for the plaintiff, acts as an artist painting the strongest and most persuasive picture before the jury.
If the picture is painted correctly, the insurance company may settle before going to trial. It is what a jury sees in that picture that will persuade them to find for my client and award a sizable verdict.
